Introduction
Welcome to Berserk Designs! We value every partnership and aim to deliver high-quality results that align with your vision and our skills. To ensure clear and efficient collaboration, we’ve outlined our Terms of Service below. These terms establish the foundation of our working relationship, covering project expectations, payment structures, and communication protocols. By agreeing to these terms, you help us create a productive and respectful working environment for both parties
Project Scope
To ensure clarity and avoid misunderstandings, we will discuss and finalize the project scope in detail before commencing work. This includes:
Agreed methods of communication, such as weekly meetings or email updates, for sharing progress and updates.
- Deliverables: A clear list of items to be provided, such as designs, prototypes, final files, or additional assets.
- Timeline: A detailed schedule, including milestones and deadlines for each deliverable.
- Exclusions: Tasks or services that are not included in the project scope to set clear boundaries.
- Revisions: The number of revisions included in the project fee and how additional changes will be handled.
Originality of Design
- We kindly ask clients not to request exact copies of designs from competitors’ websites or other sources. While we’re happy to take inspiration from references you provide, our focus is on creating original and customized designs that truly reflect your brand’s unique identity.
- Our goal is to deliver creative, high-quality solutions while maintaining ethical and professional practices. Rest assured, your project will be handled with originality and care, ensuring it stands out in the best possible way.
Pricing and Revisions
Our pricing structure is designed to accommodate the possibility of extensive revisions. Whether a project requires 10 or 100 adjustments, our fees ensure that we remain fairly compensated for our time and effort. The agreed-upon project fee will account for all revisions included in the scope of work to avoid any frustration or dissatisfaction
Upfront Payment
An upfront payment is required as a safety measure to protect our time and effort. This ensures that if a client becomes unresponsive after part of the work has been completed, we are not left waiting or at a financial loss. The upfront payment fosters trust and commitment while safeguarding us from potential payment delays or communication gaps
Payment Terms
- A 30% deposit of the total project fee is required upfront before any work begins.
- The remaining balance must be paid upon final project completion.
- After the project is finalized, any additional changes or revisions will only be addressed after the final payment has been settled. Such revisions will be handled as separate tasks and billed accordingly.
Project End Date
We will not proceed with any project unless a clear deadline is established. The client must explicitly define the project’s completion date before work begins. Without this information, we reserve the right to decline the project.
Refund and Cancellation Policy
- The upfront payment secures your project slot and is non-refundable once work has commenced.
- Partial refunds may only be issued if the client cancels the project before the initial design phase begins.
For cancellations made during the project:
- A refund may be issued for the portion of the project not yet started, minus a cancellation fee to cover time and resources.
- No refunds will be issued for any completed phases or milestones.
Mid-Project Cancellations:
- If the client decides to terminate the project mid-way, they must communicate the decision in writing.
- The client is liable to pay for all work completed up to the point of cancellation, and any remaining balance for completed phases or milestones must be settled.
- Any changes in the project scope or direction after approval of the initial agreement must be agreed upon in writing. These changes may result in additional charges or timeline adjustments.
Unforeseen Circumstances:
- In the event of unforeseen circumstances leading to project cancellation, we will retain payments made but will ensure that the client receives all deliverables for completed phases.
By agreeing to these terms, you confirm your understanding and acceptance of our policies. These terms ensure a smooth, transparent, and mutually beneficial collaboration. If you have any questions or require further clarification, please feel free to reach out before proceeding.
